Agreement to Terms
Welcome to HiroFox! These Terms of Service ("Terms") govern your access to and use of the HiroFox Applicant Tracking System platform. By creating an account or using our services, you agree to be bound by these Terms.
1. Service Description
HiroFox provides a cloud-based Applicant Tracking System (ATS) that includes:
- AI-powered resume screening and candidate matching
- Job posting management and career portal hosting
- Interview scheduling and management tools
- Analytics and reporting dashboards
- Vendor and employee referral portal access (add-ons)
- Email and SMS notification services
2. User Accounts and Licenses
2.1 Account Registration
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must be 18 years or older to create an account
- One account per organization; multiple users can be added based on your license count
2.2 License Limits
- ATS User Licenses: Number of HR team members who can access the platform
- Job Post Limits: Corporate (10 active jobs) | Enterprise (100 active jobs)
- Vendor Licenses: Number of external vendors (if add-on purchased)
- Employee Referral Licenses: Number of employees who can refer (if add-on purchased)
- Exceeding license limits will require upgrade or additional purchase
2.3 Account Security
- You are responsible for all activities under your account
- Notify us immediately of any unauthorized access
- We recommend enabling two-factor authentication (2FA)
3. Subscription and Payment
3.1 Pricing and Billing
- Subscription fees are billed monthly or annually based on your selection
- Prices are in Indian Rupees (₹) and subject to applicable taxes
- Payment is due at the beginning of each billing cycle
- We accept payment via Razorpay (UPI, cards, net banking)
3.2 Renewals and Cancellations
- Subscriptions auto-renew unless cancelled before the renewal date
- You can cancel anytime from your account settings
- Cancellations take effect at the end of the current billing period
- No refunds for partial billing periods
3.3 Price Changes
We reserve the right to modify pricing with 30 days advance notice. Price changes do not affect existing subscriptions until renewal.
4. Acceptable Use Policy
You agree NOT to:
- Use the service for any illegal or unauthorized purpose
- Attempt to access or tamper with other organizations' data
- Upload malicious code, viruses, or harmful content
- Reverse engineer, decompile, or attempt to extract source code
- Resell, lease, or redistribute the service without authorization
- Use the platform to discriminate based on protected characteristics
- Send spam or unsolicited communications to candidates
- Overload or disrupt our servers or networks
5. Intellectual Property Rights
5.1 HiroFox Property
The HiroFox platform, including all software, designs, logos, trademarks, and content, is owned by HiroFox and protected by copyright, trademark, and other intellectual property laws.
5.2 Your Data
You retain all rights to the data you upload to HiroFox (candidate information, job descriptions, etc.). You grant us a limited license to process this data solely to provide our services.
6. Service Availability and Support
Service Level Agreement (SLA):
- Uptime: 99.5% monthly uptime guarantee (Enterprise plan)
- Maintenance: Scheduled maintenance with advance notice
- Support: Email support for Corporate | 24/7 priority support for Enterprise
- Response Time: 24 hours (Corporate) | 4 hours (Enterprise)
We strive for maximum uptime but cannot guarantee uninterrupted service due to factors beyond our control (internet outages, force majeure, etc.).
7. Limitation of Liability
To the maximum extent permitted by law:
- HiroFox is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees paid in the 12 months preceding the claim
- We are not responsible for hiring decisions made using our platform
- You are responsible for compliance with employment laws in your jurisdiction
8. Termination
8.1 By You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
8.2 By HiroFox
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use Policy
- Payment fails and is not resolved within 15 days
- Your account poses a security risk to our platform or other users
- Required by law or legal process
8.3 Effect of Termination
Upon termination, your access will be revoked. You can export your data within 30 days, after which all data will be permanently deleted.
9. Compliance with Laws
Your Responsibilities:
- Comply with all applicable employment and labor laws
- Ensure job postings do not violate anti-discrimination laws
- Obtain necessary consent from candidates for data processing
- Follow data protection regulations (GDPR, PDPA, etc.) in your region
- Maintain appropriate candidate data retention policies
10. AI-Powered Features
HiroFox uses AI to assist in candidate screening and matching. Please note:
- AI recommendations are assistive tools, not final hiring decisions
- Human review and judgment should always be applied
- We continuously improve AI algorithms to reduce bias
- You are responsible for ensuring fair and non-discriminatory hiring practices
11. Indemnification
You agree to indemnify and hold harmless HiroFox from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
13. Modifications to Terms
We may update these Terms from time to time. Material changes will be notified via email and in-platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
